A tenancy contract in Dubai needs a small set of documents from each side. The set originates from the requirements of Ejari registration: the signed contract must be registrable, so the parties collect these documents from the start. The same documents are how both parties verify the contract details before signing. The checklists below cover individuals and companies, on the landlord and the tenant side.
KEY TAKEAWAYS
- An individual landlord provides the title deed and a passport; if the property has several co-owners, every co-owner's passport is required. An individual tenant provides a valid Emirates ID.
- A company, whether landlord or tenant, provides its trade licence, proof of the authorised signatory (usually the MOA or a POA), and the signatory's Emirates ID.
- The set comes from what Ejari registration requires: the parties check the contract against the same documents before signing, then submit them at registration.
What the landlord provides
Individual landlord:
- Title deed. The property details in the contract are taken from it. If the property was handed over recently and the deed has not been issued yet, the Sale and Purchase Agreement (SPA) and the Oqood take its place.
- Passport. Ejari registration specifically requires the landlord's passport. The Emirates ID is added when the passport does not contain the landlord's signature, or when the landlord signs as on their Emirates ID.
If the property has several co-owners: every co-owner's passport is required. If one owner signs for the others, add the Power of Attorney and the signatory's Emirates ID.
If a representative signs for the landlord: a notarised Power of Attorney and the representative's Emirates ID.
Company landlord:
- Trade licence. The licence number and the licensing authority (for example DET or DMCC) go into the contract.
- Proof of the authorised signatory. A document showing who may sign for the company: usually the company's Memorandum of Association (MOA) or a Power of Attorney.
- The signatory's Emirates ID.
What the tenant provides
Individual tenant:
- Emirates ID. It must be valid, and the tenant's complete name in the contract must match it exactly.
If a representative signs for the tenant: a notarised Power of Attorney and the representative's Emirates ID.
Company tenant: the same set as a company landlord.
- Trade licence, with the licence number and licensing authority entered in the contract.
- Proof of the authorised signatory, usually the MOA or a POA.
- The signatory's Emirates ID.
Check the contract against the documents before signing
The same documents are each party's due diligence. Before signing, the tenant confirms from the title deed that the person letting the property owns it, and the landlord confirms the tenant's identity from the Emirates ID. Where anyone signs on another's behalf, the other party reviews the authority behind the signature. Both sides check that the contract carries the complete names exactly as on the documents, the property exactly as on the title deed, and signatures that match: mismatches in these details are the most common reasons a registration is returned. The full checklist of details is in our guide to making a tenancy contract in Dubai.
If the contract is created on Habi, the property details come from official records, and the parties can also securely share their documents on the platform for review before signing.
Where the list comes from: Ejari registration
The document set originates from the requirements of Ejari registration. After signing, the contract is registered in the Ejari system, and that is where the documents are submitted: the signed contract, the title deed (or SPA and Oqood), the landlord's passport, the tenant's Emirates ID, and the company papers or POA where they apply. Authority documents, including the POA and the signatory's Emirates ID, are checked at this step. The full registration detail and its edge cases are in our Ejari documents checklist.
